Terms and Conditions

  1. Purchasing at wholesale is only possible for companies with a gardening focus, with a minimum purchase of 1 box of plants per species, with a total order value of at least 2000,- CZK excluding VAT.

  2. Opening hours are on weekdays from 7 AM to 3 PM, by prior arrangement it is possible to pick up orders made through the e-shop even outside opening hours.

  3. We process orders in the order they are received. We accept them through the e-shop or via email. Please always provide your exact address, phone number, company ID, and VAT number, as well as a precise specification of the ordered items. When ordering from the e-shop, please fill in the pickup date for the plants in the comments section under the order, as well as any other specifications.

  4. Packaging for plant shipment

    • PE boxes (black Euro boxes, low or high), which can be exchanged at the time of delivery or purchased for 120 CZK/piece excluding VAT)

    • PE transport trays, suitable for loading onto CC trolleys (24 pieces per K9x9 tray, 3 trays per trolley shelf, 10 pieces per K11x11 tray, 6 trays per floor). Salaries are backed up.

  5. We provide plastic labels with color printing for the plants. The name tag features a color photo of the plant and a verbal description (short species characteristics, height, color and flowering period, site requirements, and recommended use). The price is 2.50 CZK/piece excluding VAT. We provide labels only for orders with full packages of plants (crate/tray - 24 pcs K9x9 per tray/crate, 10 pcs K11x11 per tray, 15 pcs K11x11 per crate). For orders of fewer pieces than a full package, we do not provide name tags.

  6. For regular purchases, loyal customers are allowed to pay by bank transfer upon agreement with the company's senior employee.

  7. The method of delivery and receipt of plants is determined by the buyer when placing the order, choosing from the seller's offer, usually between personal pickup at the seller's premises or transportation of the plants to a location specified by the buyer.

  8. Transport

    • personal pickup - free

    • regular deliveries with our Fiat Ducato MAXI van - capacity of 6 CC carts

    • Florexpress - for contract customers of Florexpress only, shipping costs are covered by the buyer

  9. In the event that the method of delivery of the plants requested by the buyer is unsuitable due to the nature of the plants, the seller shall inform the buyer of this fact. If the buyer continues to insist on an inappropriate method of plant delivery, the seller is not responsible for any damage caused by this method of delivery.

  10. In the event that the plants need to be transported repeatedly or in a different manner than stated in the order due to reasons on the buyer's side, the buyer is obliged to reimburse the seller for the costs associated with the repeated transportation of the plants, respectively. costs associated with a different method of delivery.

  11. The seller will deliver the plants to the buyer on the agreed date specified in the order.

  12. If the seller does not deliver the plants to the buyer even within a reasonable additional period provided by the buyer, the buyer is entitled to withdraw from the purchase contract.

  13. The buyer is obliged to take over and pay for the plants on time.

  14. The buyer is obliged to take over the plants without undue delay, i.e. within the period specified in the order, but no later than 14 days from this date, otherwise the buyer is in default of fulfilling their obligation to take over the plants.

  15. In the event of a delay by the buyer in taking over the plants, the seller is obliged to exercise reasonable care to prevent unnecessary loss in the value of the ordered plants. However, the buyer acknowledges that no later than the delivery date specified in the order, the plants are rearranged for order completion. A completed order typically includes plants with different cultivation requirements, and for operational and practical reasons, it is not possible to separate them according to their cultivation needs and store them in multiple locations with different care conditions. On the expedition area (and often in the same crate), there are drought-tolerant plants, moisture-loving plants, shade-loving plants, and those that require full sun side by side. Care is always consistent, optimization is not feasible, which is a significant reason for the buyer to take over the plants in a timely manner, i.e. within the agreed timeframe.

  16. If the buyer is in default with the acceptance of the plants, the seller incurs additional costs and loses profit due to the blocking of dispatch, and possibly even cultivation space, and the costs incurred to maintain the plants in reasonable condition.

  17. The buyer who is in default of taking over the plants is obliged to pay the seller a contractual penalty of 0.5% per day of the purchase price of the plants not taken over. The seller's right to full compensation is not affected by this contractual penalty or its payment.

  18. The risk of damage to the plants, including the possible death of individual pieces, passes to the buyer upon taking possession of the item. The same consequence applies if the buyer does not take over the plants within 15 days from the delivery date specified in the order.

  19. Damage to plants occurring after the risk of damage to the plants has passed to the buyer does not affect the buyer's obligation to pay the seller the full purchase price.

  20. If the buyer delays in taking over the plants, the seller has the right to sell the plants in an appropriate manner at the buyer's expense after prior notice, once the seller has provided the buyer with an additional reasonable period to take them over. This also applies if the buyer is in default with the payment, which is a condition for the delivery of the plants. If plants are in imminent danger of rapid destruction and there is no time for warning, a warning is not necessary.

  21. The buyer is obliged to inspect the plants as soon as possible upon receipt and immediately report any defects, including damage, to the seller. The buyer is particularly obliged to inspect the quantity and quality of the plants.

  22. In the case of transported plants, the buyer is obliged to report these defects to the carrier immediately and simultaneously to the seller within 2 days of their receipt. If the buyer suspects upon receipt that the plants exhibit defects, the buyer shall prepare a written record of the complaint about the plants with the carrier on the spot. In case of any ambiguities, the buyer is obliged to immediately contact the seller by phone.

  23. The invoice and possibly other documents are handed over to the buyer during personal collection, included directly in the shipment, or sent to the buyer by email.

  24. The ownership rights to the plants transfer to the buyer only at the moment of proper payment of the purchase price.
